Passport Photo Quantity Requirements for the ATF Paperwork - Individual and Gun Trust

The ATF 5320.1, ATF 5320.4, ATF 5320.5 and the ATF 5320.23 paperwork have different passport photo requirements for the ATF applications.  This can be confusing because the ATF paperwork has different passport photo quantities depending on how you are applying for your ATF tax stamp.  We break down the passport photo requirements down below:

ATF 5320.1 Application to Make and Register a Firearm:

  • If you are applying as an individual: You will affix two passport photos to your ATF 5320.1 application for the two ATF copies.  
  • If you are applying with a gun trust or legal entity:  You will only supply one passport photo for each responsible person in the gun trust or legal entity.  Your photo will be affixed to the ATF 5320.23 Responsible Person Questionnaire.

ATF 5320.4 Application for Tax Paid Transfer and Registration of Firearm:

  • If you are applying as an individual: You will affix two passport photos to your ATF 5320.4 application for the two ATF copies.  
  • If you are applying with a gun trust or legal entity:  You will only supply one passport photo for each responsible person in the gun trust or legal entity.  Your photo will be affixed to the ATF 5320.23 Responsible Person Questionnaire.

ATF 5320.5 Application for Tax Exempt Transfer and Registration of Firearm:

  • If you are applying as an individual: You will affix two passport photos to your ATF 5320.5 application for the two ATF copies and affix one passport photo to the CLEO copy of your ATF 5320.5 application.  
  • If you are applying with a gun trust or legal entity:  You will only supply one passport photo for each responsible person in the gun trust or legal entity.  Your photo will be affixed to the ATF 5320.23 Responsible Person Questionnaire.

ATF Form 5320.23 Responsible Person Questionnaire:

  • This form is only to be used for applicants who are applying with a gun trust or legal entity.  Each responsible person named in your gun trust or legal entity will need to affix one passport photo to their respective ATF 5320.23 form.
